Information we may collect from you

We may collect and process the following data about you:

  • Information you give us. You may give us information about you by filling in forms on our site www.thegrid.ae (the “Site”) or by corresponding with us by phone, e-mail or otherwise. This includes but it not limited to information you provide when you register to use the Site, subscribe to our service, search for a product, place an order on the Site, participate in discussion boards or other social media functions on the Site, enter a competition, promotion or survey, and when you report a problem with the Site.     • information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from the Site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call The Grid Initiative.

  • if you use any of the other websites we operate or any of the other services we provide. Uses made of the information

We use information held about you in the following ways:

  • Information you give to us. We will use this information:
    • to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;
    • to provide you with information about other goods and services we offer that are similar to those that you have already purchased or enquired about;
    • to provide you, or permit selected third parties to provide you, with information about goods or services we feel may interest you. Disclosure of your information

We may share your personal information with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in paragraph 4 of Schedule 1 of the DIFC Companies Law (No. 2 of 2009).

We may share your information with selected third parties including but not limited to:

  • business partners, suppliers and sub-contractors;
  • advertisers and advertising networks that require the data to select and serve relevant adverts to you and others.  We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience;
  • analytics and search engine providers that assist us in the improvement and optimisation of the Site; and
  • credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you.

We may disclose your personal information to third parties:

  • in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
  • if The Grid Initiative or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets; and/or
  • if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of The Grid Initiative , our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we store your personal data

In accordance with the terms of use, the data that we collect from you may be transferred to, and stored at, a destination outside the United Arab Emirates (UAE) and other GCC Countries. It may also be processed by staff operating outside the UAE  who work for us or for one of our suppliers. By submitting your personal data, you agree to this transfer, storing or processing. The Grid Initiative will take reasonable steps to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted [using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. Access to information

You have a right to access personal data held about you. Any access request may be subject to a reasonable fee (approx AED 35) to meet our costs in providing you with details of such information. Further, you may request that we correct any inaccuracies in your data free of charge.

They cannot be used on a website other than this Site without our prior written consent (which may be given or withheld at our sole discretion). Nothing contained herein shall be construed as conferring any license or right under any patent, trademark, copyright (except as expressly provided above), or other proprietary rights of The Grid Initiative or of any third party.

Indemnity by you

By accessing this Site, you hereby agree to fully indemnify and to hold The Grid Initiative harmless from and against any claim brought by a third party arising from or in connection with any use of the Site by you and in respect of all losses, costs, actions, proceedings, claims, damages, expenses (including legal costs and expenses), or liabilities whatsoever suffered or incurred directly or indirectly by The Grid Initiative in consequence of such use of the Site or your breach or non-observance of any of these terms of use.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to the Site, or to make contact with other users of the Site, you must comply with the content standards set out in our Acceptable Use Policy.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. We have the right to remove any posting you make on the Site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

When you upload, provide or post content to the Site, you grant The Grid Initiative, a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user generated content in connection with the service provided by the Site and across any other forms of media. Further, we may use the content to promote the Site or the service on an unrestricted basis.

For the avoidance of doubt, the above license will not expire should the user or The Grid Initiative delete any content from the Site.

Linking to the Site

You may link to our home page and “Watch” page provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists and you must not establish a link to the Site in any website that is not owned by you.

The Site must not be framed on any other site, nor may you create a link to any part of the Site other than our home page and “Watch” page .We reserve the right to withdraw linking permission without notice.

Viruses

These terms of use are governed by the laws of Dubai International Financial Centre, and any dispute arising out of or in connection with these terms of use shall be subject to the exclusive jurisdiction of the courts and tribunals of the Dubai International Financial Centre.

The Grid Initiative nonetheless reserves the right to take legal proceedings in any jurisdiction other than of the Dubai International Financial Centre, to protect its interests or to enforce its rights whenever it deems it appropriate to do so.

Content standards

These content standards apply to any and all material which you contribute to the Site (contributions), and to any interactive services associated with it.

  • be genuinely held (where they state opinions); and

  • contain any material which is obscene, offensive, hateful or inflammatory;
  • promote sexually explicit material;
  • promote violence;
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • infringe any copyright, database right or trade mark of any other person;
  • be likely to deceive any person;
  • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • promote any illegal activity;
  • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
  • be likely to harass, upset, embarrass, alarm or annoy any other person;
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • give the impression that they emanate from us, if this is not the case; or
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of the Site.  When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use the Site, and may result (but is not limited to) in our taking all or any of the following actions:
